Requirements of Agency Registration with the Concerned Ministry

Being duly empowered to register agencies and follow up relating activities within the UAE as per the provision of Federal Law No. (18) Of 1981 and the amending Law No. (14) Of 1988, The Department of Interior Trade at the Ministry of Economy & Commerce should be approached by agents requesting registration of their agreements in the special register prepared for the purpose.
 
Registration procedures at the Ministry may be summed up in the following points.
 
Completion of a special application form in which the Chamber's member agent should write down all information such as his name, nationality and address; his principal's name, nationality and address; goods and services subject matter of the agreement; territory covered according to the agreement, date of effect and date of expire. (Form No. 2)

The above application form should be attached to the following documents:

a. Originals and Copies of the Trade License and Commercial Register Certificate issued by Abu Dhabi Municipality Department, as well as the Membership Certificate issued by the Abu Dhabi Chamber of Commerce & Industry.
b. Original and copy of agency agreement duly attested and authenticated by the aforementioned concerned authorities in both countries and legally translated into Arabic if the original agreement has been drawn in a foreign language.

c. Original and copy of Civil Status extract or identity card (if he is a national individual establishment).
d. Articles of association and letter of incorporation duly at-
tested by the concerned authority and a copy of each of them, along with a certificate certifying that all partners are holders
of the UAE nationality (if he is a national company).

The Ministry views application and issues decision within fifteen days from the date of submission. In case of approval,
the agent is granted an accredited certificate denoting registration. The decision is, thereafter promulgated in the official gazette along with pertinent details and notified to Municipality and Customs departments, as well as to the
Federation of UAE Chambers of Commerce & Industry.

as per the provisions of Federal Law No. (18) Of 1981 and the amending Law No. (14) Of 1988, article (12), the Ministry has the right to refuse an application in case of failure to meet the terms provided in the law. In such cases, the Ministry should notify the concerned of the reasons justifying refusal within one month from the date of application submission. Notification is usually sent by registered mail or delivered by hand. However, in case such notification hasn't been made by the Ministry, it should be understood as refusal. Whoever his application is refused, may have the right of appeal against the Ministry's decision before the concerned Civil court within sixty days from the date of notification on refusal or after one month from the date of application without a reply from the Ministry.

Once registration is effected in the Commercial Agents Register kept by the Ministry, the agent should inform it of any alteration or amendment that might be introduced to the agreement or the statements provided in the Law within sixty days from the date of amendment or alteration occurrence.
In case an agency agreement is rescinded or expired, the agent; his legal attorney or his inheritors in case of demise should apply to the Ministry with supporting documents requesting agreement write-off in The register of the Commercial agents within sixty days from the date of rescindment; demise or expire.
The agent should provide the Chamber with copies of the following documents so as to be kept in his file.

a. Copy of the original agency agreement and the legal translation in case it is initially written in a foreign language.
b. Copy of the registration Certificate issued by the Ministry of Economy & Commerce after registration in the pertaining register.
